Letter of Court Hearing Date to
Pastor Eric Phelps, Elizabethtown KY
and to Mark Fraze, Eddie Johnson, Thomas Turner;
from Attorney for The Church of God representatives
Herbert J. Graham, Sr. & John Talley;
Dated:  January 5, 2006

Since the majority of the local church at Elizabethtown, Kentucky, are standing with Pastor Eric Phelps, they continue to be considered, for all intents and legal purposes, the congregation of the Elizabethtown Church that rightfully possess the local church property.

The two individuals cited as the plaintiffs in the Attorney letter below are blatantly disregarding Scriptural commands by taking their brothers and sisters in Elizabethtown to court in an attempt to take the church property which rightfully belongs to them.

Note: The court date of January 17 cited in the letter below has been contested and received a continuance from the court to allow time for defense preparation.  The new date scheduled by the court is Februarry 10.  Updates will be available on the Legal Updates section of Setting the Record Straight.
